Minnesota Drug Testing Policy

The State of Minnesota has adopted one of the most restrictive drug and alcohol testing statutes in the country.  Among other things, employers must adopt a written and legally compliant drug and alcohol testing policy prior to testing job applicants and employees.

If you are an employer, you should become familiar with Minnesota's strict legal requirements before conducting drug or alcohol testing of any job applicants or employees. Most of these requirements can be found in the Minnesota Drug & Alcohol Testing in the Workplace Act, Minn. Stat. § 181.950 et seq.

Minnesota employers may also be covered by U.S. Department of Transportation ("DOT") drug and alcohol testing regulations for "safety sensitive" transportation employees. Commercial truck drivers are the largest group of employees covered by these DOT regulations. The Federal Motor Carrier Safety Administration ("FMCSA") oversees the implementation of the federal drug and alcohol testing rules for commercial drivers, located at 49 C.F.R. Part 382.

If you need assistance updating or drafting your Minnesota drug and alcohol testing policy, attorney Craig W. Trepanier can help.  Since 1994 he has spoken and written extensively on the topic of workplace drug testing, drafted hundreds of drug and alcohol testing policies for Minnesota employers, and litigated claims surrounding positive drug tests.

Mr. Trepanier typically drafts drug and alcohol testing policies for a flat fee.  To receive a quotation, call him today at 612-455-0502 or contact him by e-mail at craig@trepanierlaw.com.  The cost of your policy will depend on several factors such as the number of states in which you operate, whether you need a "DOT policy," "Non-DOT policy," or both, and the number of employees to be covered by the policy.  The drug testing package also includes a set of forms, checklists, and other legal compliance materials such as acknowledgment and notification forms.

We look forward to drafting your Minnesota drug testing policy.
